TERMS:
PREPAYMENT IS REQUIRED ON ALL ORDERS. METHODS OF PAYMENT ARE:
• Credit Cards via Paypal: We accept MasterCard, Visa,
American Express, and Discover.
• All payments are processed by shdow.com DBA/ ordergiftcertificate.com
• All sales are final.
PRICE AND TAX
All federal, state, and local taxes and fees with respect to this order, if any, are payable by Purchaser. Orders which are not shipped within 90 days of the date of this Agreement because of Purchaser's instructions shall be subject to price increase without notice.
SHIPPING/DELIVERY TERMS
Orders are processed and shipped same day if the order and payment
are received by 2:00pm Eastern time, Monday through Friday. Orders of 10 pieces
or more will be shipped the following business day. Standard processing includes
shipment via Postal Service Certified mail. Priority shipping is available via
FedEx Two-Day for a nominal fee, calculated after button has been clicked on
respective page when ordering. All delivery expenses, including transportation,
freight, insurance, and any other shipping costs, shall be for the account of
Purchaser. Risk of loss shall pass to the purchaser upon deposit in US Mail
or with Federal Express. Unless otherwise instructed, selection of carrier
and routing of all shipments shall be at the discretion of OrderGiftCertificate.com.
For Manassas, Bristow and Gainesville, VA shipments, they may be delivered by
one of our delivery personnel. this does not change the shipping charges for
FEDEX or USPS. OrderGiftCertificate.com has the right to deliver using our own
delivery personnel to Manassas, Bristow and Gainesville, VA areas, regardless
if you choose FEDEX or USPS.
RECIPIENTS
If no "other" recipient name, address, or other pertinent shipping information is specified upon order/checkout form, the gift certificate shall be shipped to purchaser-regardless if "someone else " has been checked on main order form. OrderGiftCertificate.com shall not be held liable for shipment to wrong address, if any mistakes, omitting, or deletions were made in the input of address by purchaser.
GIFT CERTIFICATES
• Cannot be returned or exchanged.
• Expired, lost, or stolen gift certificates cannot be reissued.
• Are fulfilled to the address supplied on the order form. OrderGiftCertificate.com
will not be
responsible for lost certificates as a result of non-delivery due
to incorrect or illegible
addresses or other occurrences outside of our control. Title and
risk of loss shall pass to
the purchaser upon deposit in the US Mail or with Federal Express.
• Gift certificates are only valid in the US as allowed by merchant.
• The issued gift certificates sent by USPS (where the carrier has attempted
delivery to the specified address), and is not able to deliver it due to recipient
inaccessibility the gift certificate will be returned to sender if is not pick-up
by recipient according to local postal office terms. If ordergiftcertificate.com
receives the gift certificate back, an $8.00 fee will be charged to the recipient
in order to re-ship it. Gift certificates cannot be picked at our local office.
MEGACERTIFICATE
• Cannot be returned or exchanged. Can only be redeemed
on ordergiftcertificate.com website.
• Expired, lost, or stolen MegaCertificate cannot be reissued.
• Are fulfilled to the address supplied on the order form. OrderGiftCertificate.com
will not be
responsible for lost certificates as a result of non-delivery due

addresses or other occurrences outside of our control. Title and
risk of loss shall pass to
the purchaser upon deposit in the US Mail or with Federal Express.
MERCHANT LISTS
The participating merchant listings are subject to change without notice. If a merchant changes its type of business operation, goes out of business, is closed due to fire or any other act beyond our control, title and risk of loss shall pass to the purchaser upon deposit in the US Mail or with Federal Express.
MERCHANT COPYRIGHTS
OrderGiftCertificate.com is not affiliated with any participating merchants. All registered trademarks or trade names are the property of the respective merchant.
GIFT CERTIFICATE TERMS
Each merchant establishes its own policies. Gift certificates feature specific merchant terms and conditions, including expiration date and any cash back policies. OrderGiftCertificate.com shall be held blameless if merchant chooses to change specific terms between time of sale from OrderGiftCertificate.com and time of redemption.
UNKNOWN CIRCUMSTANCES
OrderGiftCertificate.com shall not be liable for any delays in the delivery of orders, due in whole or in part, directly or indirectly, to fire, acts of God, strike, shortage of raw materials, supplies or components, retooling, upgrading of technology, delays of carriers, embargo, government order or directive, or any other circumstance beyond OrderGiftCertificate.com reasonable control. Purchaser agrees that OrderGiftCertificate.com shall not be liable for any direct, indirect, consequential or special damages which may result from any such delays.
LIMITATION OF LIABILITY
In no event shall OrderGiftCertificate.com be liable for any indirect, consequential or special damages and in all cases OrderGift Certificate.com liability shall not exceed the purchase price of the Award or Certificate. INSPECTION AND ACCEPTANCE: Purchaser must inspect delivered Awards and/or Certificates and report claim for damages or shortages in writing within five (5) days of delivery or the Certificates shall be deemed irrevocably accepted and such claims shall be deemed waived.
MISCELLANEOUS
If any provision of this Agreement is found to be invalid
or unenforceable in any respect, the validity and enforceability of the remaining
provisions shall not be affected. All clerical errors are subject to correction.
The failure of OrderGiftCertificate.com to enforce
at any time any of the provisions of the Agreement shall not be construed to
be a waiver of such provisions nor the right of OrderGiftCertificate.com to
enforce such provisions in the future. Purchaser may not assign any rights under
this Agreement without the written consent of OrderGiftCertificate.com. Purchaser
shall have no right to set off amounts due with respect to one transaction for
claims under any other transaction with OrderGiftCertificate.com.
Any disputes arising under this Agreement shall be resolved, if not sooner settled,
by a state or federal court of competent jurisdiction located in Prince William
County, Manassas, Virginia U.S.A., and the Purchaser hereby irrevocably submits
to the exclusive jurisdiction of such courts.
